By accessing or using the ADS-B Nigerian Airspace Alert System ("the Service"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Service. These terms apply to all individual subscribers, company subscribers, and visitors.
The Service provides real-time and near-real-time alerts about aircraft activity over Nigerian airspace based on Automatic Dependent Surveillance-Broadcast (ADS-B) signals received by our ground-based receiver network. Alerts are delivered via email and/or Telegram.
The Service is informational in nature only. It is not a certified aviation safety system, an air traffic control tool, or an authoritative source of flight information.
You must be at least 18 years of age and capable of entering into a legally binding contract under Nigerian law to use this Service. By subscribing you confirm that you meet these requirements.
You agree not to:
TO THE MAXIMUM EXTENT PERMITTED BY NIGERIAN LAW, THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:
Our total liability to you for any claim arising from use of the Service shall not exceed the amount you paid us in the 3 months preceding the claim.
We do not guarantee uninterrupted availability of the Service. The Service depends on hardware receivers, internet connectivity, power supply, and third-party infrastructure, all of which may experience outages. We will endeavour to maintain high uptime but make no contractual commitment to specific availability levels unless stated in a separate written Service Level Agreement.
ADS-B data depends on aircraft transponders broadcasting correct information. We cannot verify the accuracy of transponder data. Aircraft may appear at incorrect positions, altitudes, or speeds due to transponder errors or multipath signal interference. See our Disclaimer for full details.
All software, design, algorithms, and content comprising the Service are the exclusive property of ADS-B Nigerian Airspace Alert System. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not copy, redistribute, or create derivative works from any part of the Service without written permission.
We reserve the right to suspend or terminate your access at any time without notice if you violate these terms. Individual subscribers may unsubscribe at any time via their unsubscribe link. Company subscribers may cancel via their portal; access continues until the end of the current billing period.
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Federal Capital Territory, Abuja, Nigeria.
We reserve the right to modify these Terms at any time. We will notify active company subscribers of material changes by email at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance.
